Clients must be aware of our terms and conditions as laid out here and accept the risks associated with these activities. All-Star Academy Fitness Boot Camp strongly recommends that clients take out personal accident, personal liability, holiday and cancellation insurance before attending camp.
These terms and conditions are modified from time to time so please ensure you are aware of the recent terms and conditions at the time of signing a contract with All-Star Academy.
All-Star Academy accepts bookings subject to the following terms and conditions:
Interpretation and Definitions
1.1 The following expressions shall have the following meanings:
'Balance’ Full amount must be paid after week one (taster week) of the programme, by cash or bank transfer as per website.
'Booking form' is the booking form produced by All-Star Academy, to be completed by the client upon joining All-Star Academy.
‘Client’ The person, firm or company who makes a booking with All-Star Academy must be a minimum age of 18.
'Contract' is the agreement between the client and All-Star Academy under which services are to be provided by All-Star Academy to the client.
'Course Director' means the representative of All-Star Academy is responsible for the delivery of the boot camp and other agreed services under the contract.
'Force Majeure' means any situation or event beyond the control of All-Star Academy including, but not limited to, an act of God, terrorist activity or war, industrial action, civil strife, rioting or other law-breaking by whomsoever, disaster, accident, break-down, fire, breach of contract by suppliers or contractors of All-Star Academy, compliance with any legal rule or governmental order, adverse weather or road conditions, travel disruption or changes in public transport schedules, quarantine, epidemics and government action.
'Major change' means a change of date, location, or more than 80% of services offered by All-Star Academy Boot Camp.
'Recording' means photographs or other recordings of the client during the provision of the services.
'Services' refers to those services provided by All-Star Academy to the client during the boot camp booked by the client or in connection to the boot camp booked by the client and may include, but are not limited to, training sessions, advice, documentation and other activities provided by All-Star Academy for the benefit of the client.
1.2 Headings used in these Terms and Conditions are for the readers' convenience and shall not affect their interpretation.
1.3 Failure by either party to enforce at any time one or more of these Terms and Conditions shall not be considered a waiver of them or of the right subsequently to enforce any or all of the Terms and Conditions of this agreement.
Acceptance
2.1 A contract for the provision of services by All-Star Academy is made between All-Star Academy and the Client when the balance is paid.
2.2 By entering into a contract with All-Star Academy, the Client is deemed to have read and accepted these Terms and Conditions, which may only be altered with the written agreement of All-Star Academy.
2.3 The contract between All-Star Academy and the client contains the entire agreement between the parties concerning its subject matter; no verbal representations made by All-Star Academy can be relied upon by the Client.
Booking
3.1 A booking is made when the Client completes a booking form and associated additional forms and pays the full amount of the booking fee. All-Star Academy reserves the right to decline any booking at its sole discretion. All bookings are provisional until the full amount is received in cleared funds in All-Star Academy’s bank account.
3.2 Signing the booking form signifies the Client's acceptance of the Course Director's authority to make decisions affecting the group or individuals on boot camp.
Payment & Discounts
4.1 Full payment of the total agreed cost of the booking is payable at the time of making a booking to secure the Client's place on boot camp. In the event that the balance is not paid on time, All-Star Academy has the discretion to treat the booking as cancelled by the client and re-sell the place.
4.2 All-Star Academy accepts payment by cash, bank transfer or standing order as per website.
4.3 All-Star Academy may at its discretion offer Clients a discount on future bookings. Discounts are strictly non-transferable and All-Star Academy reserves the right to withdraw a discount at any time and without giving a reason and in such a situation no compensation will be payable to Clients.
Client Responsibilities
5.1 It is the Client's responsibility to inform All-Star Academy in writing of any health issues that may make them unsuitable to participate in all or some of the sessions and activities provided on boot camp. If All-Star Academy believes a Client's health or safety is at risk, or that a Client has failed to disclose any relevant health information in accordance with these conditions, All-Star Academy has absolute discretion to withdraw the Client from the session, activity or entire boot camp without refund and/or may terminate the Contract without refund.
5.2 Participating in All-Star Academy involves vigorous physical activity. All-Star Academy recommends that all clients speak to their GP about this ahead of attending. All Clients must complete a PAR-Q form before attending, which has been designed to identify the small number of adults for whom physical activity might be inappropriate or those who should have medical advice concerning the type of activity that is most suitable for them. If any of the PAR-Q questions are answered 'Yes' then the Client absolutely must speak to their GP in order to establish their suitability for All-Star Academy. All-Star Academy assumes no responsibility for persons who undertake physical activity.
5.3 Clients shall abide by any rules or instructions laid down by All-Star Academy in regards to safety or proper practice. All-Star Academy reserves the right to expel without refund a Client from boot camp for taking part in any illegal activity during the course of boot camp or any conduct which may offend or cause danger or damage to any person or property. All-Star Academy will have no liability to the Client in such circumstances.
5.4 The Client shall not at any time during or after taking part on a boot camp use information gained from All-Star Academy for commercial purposes or financial gain, nor divulge the personal information of other clients at All-Star Academy.
5.5 It is the client's responsibility to arrange and pay for travel to and from boot camp. The Client is also responsible for his/her own medical needs and personal footwear, equipment and clothing.
Variations and Amendments
6.1 Information published by All-Star Academy is for general illustrative purposes only. All-Star Academy reserves the right to alter the precise content of its boot camp itineraries at any time without notice to the Client, provided the boot camps remain generally of the type described. The Course Director will review and may alter the programme as the boot camp progresses in response to the changing influence of factors such as weather conditions, and the level of fitness and aptitude of Clients.
6.2 All-Star Academy reserves the right to change any price or other particulars of the Services before the client makes a booking and pays.
6.3 If there is a Major Change to a confirmed booking All-Star Academy will inform the Client as soon as is reasonably practical and offer the Client the choice of accepting the change or receiving a full refund.
6.4 If there is any change other than a Major Change, All-Star Academy is not obliged to inform Clients in advance (though will do so where practicable) nor are they obliged to pay compensation. If All-Star Academy is unable to provide a major proportion of the services booked by the Client with All-Star Academy, it will make every effort to arrange alternative arrangements for the Client and where appropriate will refund the Client for services not received.
6.5 All-Star Academy reserves the right to cancel a boot camp that has 4 or fewer participants or make other fundamental changes such as changing the venue.
Representations by All-Star Academy
7.1 All-Star Academy gives examples on its website and in its literature of typical results that can be achieved by Clients attending boot camp. These are examples only and All-Star Academy makes no guarantee of results; all Clients are different and will achieve varying results.
Client Participation
8.1 If the Client elects not to participate in any part of the sessions or activities provided by All-Star Academy, All-Star Academy has no obligation to provide an alternative, and the Client will not be entitled to a refund. The Client cannot expect to maximise their results if they choose not to participate fully in the itinerary created for them by the Course Director.
8.2 Should a Client injure him/herself during the course of a boot camp and require going home because of the injury, All-Star Academy has no liability for additional costs incurred as a result of this and in such circumstances will not offer Clients a refund.
Cancellations
9.1 A Client wishing to cancel their contract with All-Star Academy must give 30 days’ notice and advise All-Star Academy of this in writing or by email.
9.2 Participants who don't show up to boot camp and who do not inform All-Star Academy will forfeit the full cost of their booking.
Complaints
10.1 If there is a problem during the course of a boot camp, the Client should report this to the boot camp coach.
Liability
11.1 None of the exclusions and limitations in our terms and conditions are intended to limit any rights which the Client may have under statute nor in any way to exclude or limit liability to the Client for personal injury or death resulting from All-Star Academy’s negligence or that of its employees or agents or for any liability incurred as a result of fraud or fraudulent misrepresentation by All-Star Academy.
11.2 The Client understands that engaging in the Services involves a level of risk. These risks include (but are not limited to) physical injury or even death. By engaging in the Services provided by All-Star Academy the Client agrees to assume these risks and agrees to release and discharge All-Star Academy and its directors and employees and agents from any direct, indirect or consequential loss or damage and all and any claims, actions, proceedings, liabilities and costs arising from, or in any way connected with, the Services.
11.3 Neither All-Star Academy nor any of its partners, employees, contractors or agents will be liable for any loss or damage to any personal property or vehicle belonging to the Client during the boot camp.
Photographs and recordings
12.1 All-Star Academy reserves the right to take photographs and/or recordings of Clients during the boot camp and the Client accepts that all rights whatsoever arising in these shall be owned solely by All-Star Academy. The Client accepts and agrees that these may be used by All-Star Academy on its website and in its literature for the purposes of promoting and advertising All-Star Academy.
Copyright
13.1 All literature and course material produced by All-Star Academy including, but not limited to, websites, forms, images, videos and graphics are the sole property of All-Star Academy and may not be copied or duplicated for personal or commercial use. All-Star Academy reserves all copyrights.
Law and Jurisdiction
14.1These terms of use will be governed by and construed in accordance with English law, and any disputes relating to these terms of use will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
14.2 A person who is not a party to this agreement has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any terms of this agreement.
